Welcome to espparties.com (the “Site”), operated by ESP Parties (“we,””us,” or “our”). These Terms of Use (“Terms”) govern your access to and use of the Site and our photo booth rental and related services, including but not limited to open-air booth experiences, AI features, and media creation (collectively, the “Services”).

By accessing or using the Site or booking our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you must not access or use the Site or Services.

Services Overview

ESP Parties provides luxury, open-air photo booth experiences for weddings, corporate events, and special celebrations. Our Services utilize professional lighting, DSLR cameras, and state-of-the-art AI technology to create high-quality photos, GIFs, videos, and stylized images.2. Intellectual Property Rights

Site Content and Ownership

All content on the Site, including text, graphics, logos, images, software, and the overall design (excluding User Content), is the property of ESP Parties or its content suppliers and is protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any content without our express written permission.

Event Media (Photos, Videos, GIFs)

  1. Ownership: ESP Parties retains the copyright and ownership of all photographs, videos, and other digital media captured by our photo booths (“Event Media”).
  2. License to Client: Upon full payment for the Services, you are granted a non-exclusive, non-transferable license to use, reproduce, and share the Event Media for personal, non-commercial use (e.g., sharing on social media, making personal prints).
  3. Promotional Use: Unless otherwise agreed upon in a signed Model Release or Gallery Release form, you grant ESP Parties the right to use, reproduce, and display select Event Media for our own business purposes, including marketing and promotion on our website and social media.
  4. AI Transformation: You acknowledge that the use of our AI Booth Services involves advanced AI, machine learning, and automated tools that may transform or alter the appearance and presentation of the photos and videos captured.

Customizations and Branding

Any custom templates, overlays, or branded designs created for your event remain the intellectual property of ESP Parties, though you are licensed to use the final Event Media incorporating those designs.

User Conduct

You agree to use the Site and Services only for lawful purposes. You must not:

  • Use the Services to capture or create any content that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable.
  • Interfere with or disrupt the operation of the Site or the photo booth equipment at an event.
  • Attempt to gain unauthorized access to any parts of the Site or related systems.

Booking and Payment

All bookings are subject to availability and formal agreement between ESP Parties and the client.

  • Quotes: Pricing and scope of work are determined through consultation.
  • Payments: Payments for Services are processed through secure third-party payment providers (e.g., Stripe). ESP Parties is not responsible for the security or privacy practices of these third-party processors.
     

Disclaimers and Limitation of Liability

No Warranties

The Site and Services are provided on an “as is” and “as available” basis. We make no warranties, express or implied, regarding the Site’s operation, the accuracy of its content, or the quality of the Services, except as explicitly guaranteed in a separate service agreement.

Limitation of Liability

In no event shall ESP Parties be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Site or our Services, even if we have been advised of the possibility of such damages.

Third-Party Links and Services

The Site may contain links to third-party websites or services (e.g., social media platforms, payment processors, image editing tools like Pixlr, or our website host Squarespace). These links are provided for your convenience. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party sites or services.

Indemnification

You agree to indemnify, defend, and hold harmless ESP Parties, its owners, and employees from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with your access to or use of the Site or Services, including any violation of these Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law principles. You agree that any legal action or proceeding related to the Site or Services shall be brought exclusively in the state or federal courts located in Massachusetts.

We reserve the right to modify or replace these Terms at any time. We will indicate the “Effective Date” at the top of this page. Your continued use of the Site or Services after any such changes constitutes your acceptance of the new Terms.
